The Supreme Court upheld the constitutional validity of the Uttar Pradesh Board of Madarsa Education Act, 2004 (Madarsa Act).
The SC also declared that madrasas can't grant degrees of higher education since that's violative of the University Grants Commission Act.
This case is known as Anjum Qadri and Anr vs Union of India & Ors.
On March 22, the Allahabad high court had declared the Act as “unconstitutional” and violative of the principle of secularism.
Madarsas provide both religious education in Islamic tenets and practices as well as mainstream secular education.
The Madarsa Act provides a legal framework for these institutions in UP.
It has established the Uttar Pradesh Board of Madarsa Education (the Board), which prepares and prescribes course material, and conducts exams for all courses.
The Act also gives power to the state government to create rules to regulate the Madarsa education.
