The Supreme Court on 10th January said that access to the Internet is a fundamental right under Article 19 of the Constitution.
Any order passed to restrict or suspend judicial scrutiny will be subject to judicial scrutiny.
This was a verdict given by a five-judge bench headed by Justice NV Ramana.
The internet shutdown in Kashmir is the longest in any democracy in the world.
India also tops the list of Internet shutdowns globally.
According to the Internet Shutdown Tracker, India saw 106 shutdowns in 2019, and 134 in 2018.
Backdrop
The Information Technology Act, 2000, the Criminal Procedure Code (CrPC), 1973 and the Telegraph Act, 1885 are the three laws that deal with suspension of Internet services.
But before 2017, Internet suspension orders were issued under section 144 of the CrPC.
In India, Kerala had become the first state in 2017 to declare access to Internet "a basic human right".
