The Rajya Sabha passed the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Bill.
The legislation will guide the appointment of the Chief Election Commissioner (CEC) and the Election Commissioners (EC) in future.
This legislation replaces the Election Commission (Conditions of Service of Election Commissioners and Transaction of Business) Act, 1991.
The number of ECs will be determined periodically by the President.
The appointment of the Commission will be made by the President based on the recommendations of the Selection Committee.
The Committee consists of
Prime Minister
A cabinet minister, and
The Leader of the Opposition in the Lok Sabha (or the leader of the single largest opposition party).
Recently, SC (Anoop Baranwal case) ruled that the election commissioners shall be selected by a committee comprising the Prime Minister, the Leader of Opposition, and the Chief Justice, until the parliament frames a law prescribing the selection process.
