Appointment of Chief Election Commissioner

  • The Rajya Sabha passed the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Bill.
  • The legislation will guide the appointment of the Chief Election Commissioner (CEC) and the Election Commissioners (EC) in future.
  • This legislation replaces the Election Commission (Conditions of Service of Election Commissioners and Transaction of Business) Act, 1991.
  • The number of ECs will be determined periodically by the President.
  • The appointment of the Commission will be made by the President based on the recommendations of the Selection Committee.
  • The Committee consists of
    • Prime Minister
    • A cabinet minister, and
    • The Leader of the Opposition in the Lok Sabha (or the leader of the single largest opposition party).
  • Recently, SC (Anoop Baranwal case) ruled that the election commissioners shall be selected by a committee comprising the Prime Minister, the Leader of Opposition, and the Chief Justice, until the parliament frames a law prescribing the selection process.
