The Supreme Court held that its 2014 ruling which struck down Section 6A of the Delhi Special Police Establishment (DSPE) Act would be applied retrospectively.
Section 6A of this act introduced in the Act in 2003.
It provided that sanction from the central government was mandatory before the CBI could conduct probes in corruption cases against bureaucrats of the rank of joint secretary and above.
The Court stated that Section 6A violated fundamental rights and that once a law is declared unconstitutional, it is void from its inception.
