  • The Supreme Court observed that if the Court is satisfied that the dying declaration is true and voluntary, it can be made sole basis for conviction without any further corroboration.
  • This was held during the Naeem Vs. State of Uttar Pradesh.
  • During the case of Atbir v. Government of NCT of Delhi, the Supreme Court laid down certain factors to be taken into consideration while resting the conviction on the basis of dying declaration.
